Question:
I have been cascaded an HRBP presentation including the following:
“Page 5
Assumed Consent
- Employees should have some freedom to vary the non-fixed start or end of the day.
- Assumed consent means employees do not need to seek permission but can consult colleagues and self-decide their non-fixed arrival or departure time ensuring business needs are met.
- Only works on the basis that the working pattern arrangements have guaranteed the required level of resource at the time. Employees cannot leave, except in emergencies, if there will be customer service impacts.

Morning start time/ Flexi on before 08:00
- Colleagues who fix an 8.00 start may arrive from 7.30 but only if:
– Their line manager agrees
– There is work for them to do
– That is the most productive time to do that work
– Any early attendance does not adversely impact the team’s ability to cover later in the day”
Can you please confirm, as the details above are not in the Employee Deal if the employer has withdraw this document.
Answer:
This HRBPS document was withdrawn.
No such HRBP presentational packs should be used to determine any issue that may arise.
It is not a ‘factsheet’ or a definitive statement of DWP Policy, Procedure and Advice unless it specifically quotes the exact wording of a Policy, Procedure or Advice.
If a HRBP is still using this version of the pack, please provide me with their contact details so I can arrange to have them advised again to stop doing so.
